End User License Agreement (EULA)

This End User License Agreement (“EULA”) is a legal agreement between you and LifeOctave (“we”, “us”, “our”) regarding your use of the LifeOctave mobile application and any related sound-based content and services (collectively, the “App”). By installing or using the App, you agree to be bound by this EULA.
This EULA is between you and LifeOctave only. Apple, Google, and any other platform provider are not parties to this agreement and are not responsible for the App or its content.
1. License Grant
Subject to your compliance with this EULA and the Terms of Use, LifeOctave grants you a limited, revocable, personal, non-exclusive, non-transferable, and non-sublicensable license to:
- Install and use the App on a device you own or control
- Access and use the audio and content within the App for your personal, non-commercial use
2. Restrictions
You agree that you will not:
- Copy, record, extract, or redistribute any audio or content provided in the App
- Modify, adapt, translate, or create derivative works based on the App or its content
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App
- Sell, rent, lease, sublicense, or otherwise transfer any rights to the App or its content
- Use the App for any commercial, competitive, or unauthorized purpose
3. Ownership
The App, including all music, sound sequences, design, code, and related materials, is owned by LifeOctave / Sound Psychomatrix or its licensors and is protected by intellectual property laws. This EULA does not transfer any ownership rights to you.
4. User-Generated Input
If the App allows you to submit or generate input, such as birth dates or sound preferences, you retain rights to that input, but you grant LifeOctave permission to process it for functionality of the App. You are responsible for ensuring that any input you provide is lawful and does not infringe on the rights of others.
5. Subscription and Payments
Payments, subscriptions, and in-app purchases are processed by Apple, Google, or the respective platform provider. LifeOctave does not store full payment card details.
We may store limited purchase or subscription-related records necessary to provide access to purchased content, restore purchases, manage subscriptions, comply with legal obligations, prevent fraud, and resolve disputes.
6. Termination
This EULA is effective until terminated by you or by LifeOctave. We may terminate your access to the App at any time if you violate its terms. Platform providers, such as Apple or Google, may also suspend or terminate your access according to their own policies.
Upon termination, you must cease all use of the App and delete it from your devices.
7. No Warranty
The App is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to any warranties of merchantability, fitness for a particular purpose, or non-infringement. Platform providers are not responsible for providing maintenance or support services for the App.
8. Limitation of Liability
To the maximum extent permitted by law, LifeOctave shall not be liable for any damages arising out of or related to your use of or inability to use the App, including indirect, incidental, consequential, or special damages.
9. Governing Law
This EULA is governed by the laws of the United States. Where required, consumer protection laws of your region may apply, and disputes may be subject to the courts of your local jurisdiction.
