These Terms of Use (“Terms”) govern your access to and use of LifeOctave (“we”, “us”, “our”), including our website, mobile app, and related services (the “Service”). By using the Service, you agree to these Terms and to our Privacy Policy.
These Terms are between you and LifeOctave only. Apple, Google, and other platform providers are not parties to these Terms and are not responsible for the Service.
1. Eligibility
You must be at least 16 years old to use the Service.
2. Use of the Service
You agree not to:
- Copy, record, extract, or distribute audio or content from the Service
- Reverse engineer or attempt to access the source code
- Use the Service for commercial, competitive, or unauthorized purposes
- Attempt to interfere with the security, integrity, or performance of the Service
3. Intellectual Property
All sound, music, algorithms, visuals, text, and digital materials are owned by LifeOctave / Sound Psychomatrix or its licensors. These rights are protected by intellectual property laws.
4. Audio Content and License
All audio content available in the LifeOctave application, including but not limited to musical tracks, sound sequences, tones, and audio-based tools, is original copyrighted material created by the owner of the application or licensed to LifeOctave.
By using the application, you are granted a limited, non-exclusive, non-transferable license to listen to the audio content solely for personal use within the LifeOctave application.
You may not download, copy, record, reproduce, distribute, transmit, modify, synchronize with video, use as background audio, or otherwise use any audio content outside of the application, whether for commercial or non-commercial purposes.
This restriction applies regardless of the method used, including but not limited to screen recording, audio recording, or any other technical means.
Any purchase, subscription, or access to the application does not transfer ownership of the audio content and does not grant any license for external use.
Unauthorized use of the audio content may result in termination of access to the application and may constitute a violation of applicable copyright laws.
5. Purchases and Subscriptions
All payments, renewals, and billing are processed by Apple, Google, or the respective platform provider, not directly by LifeOctave. Subscription details, auto-renewal rules, changes, and refund policies are described in the Subscription & Payment Terms.
LifeOctave does not store full payment card details. We may store limited purchase or subscription-related records necessary to provide access to purchased content, restore purchases, manage subscriptions, comply with legal obligations, prevent fraud, and resolve disputes.
6. No Medical or Professional Advice
The Service is not medical, psychological, therapeutic, financial, legal, tax, business, or other professional advice. It is intended for personal reflection, self-awareness, supportive listening, creative exploration, wellness-related reflection, informational purposes, and entertainment purposes only.
The Service is not suitable for emergencies, crisis support, medical decisions, financial decisions, legal decisions, or safety-critical situations.
7. Content Availability
We may update, modify, or remove features or content at any time. Certain features may require an active subscription to remain accessible.
8. No Guarantees
The Service does not guarantee outcomes, improvements, predictions, accuracy of interpretations, or changes in personal circumstances. Individual experiences may vary.
9. Limitation of Liability
To the extent permitted by law, your sole remedy for dissatisfaction with the Service is to stop using it. LifeOctave is not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for loss of profits, data, goodwill, opportunities, or other intangible losses arising out of or related to your use of or inability to use the Service.
10. Termination
We may suspend or terminate your access to the Service if you violate these Terms or misuse the Service. Upon termination, you must stop using the Service.
11. Governing Law
These Terms are governed by the laws of the United States unless consumer protection laws in your region require otherwise.
